Terms of Service

These Terms are an agreement between you and Media Buying Made Easy LLC, doing business as ToMarket (“ToMarket”, “we”, “us”). By accessing or using ToMarket at tomarket.io, you agree to these Terms. If you use ToMarket for a company, you agree on its behalf and confirm you can bind it. If you do not agree, do not use the service.

ToMarket is an AI-assisted platform for creating advertising creative and copy, researching markets and competitors, and managing campaigns on advertising platforms you connect (such as Meta, Google, and ChatGPT ads). You are responsible for the accounts you connect and the campaigns you run.

You choose how much ToMarket does on its own. In review modes, changes to your campaigns wait for your approval. In automated modes, ToMarket can create, pause, resume, and change budgets on campaigns on its own, under its built-in rules and any rules you set. You can change the mode or turn automation off at any time. You remain responsible for your campaigns and your advertising spend, including changes made under automation you turned on.

• You must have the right to connect and manage the advertising accounts you link, and to use the content you upload, including any person’s name, image, likeness, or voice.
• You may create a personal clone (an AI avatar or voice) only of yourself, or of someone who has given you their consent to do so.
• You are responsible for compliance with each advertising platform’s policies and with applicable laws in the campaigns you run, including laws on advertising claims and on the leads and personal information you collect.
• You authorize ToMarket to take actions (create, edit, pause, optimize campaigns) on connected accounts as you direct or under the automation you enable.

• Paid plans renew automatically each billing period until cancelled, and are charged through our payment processor, Stripe. Prices and what each plan includes are shown when you subscribe.
• AI generation uses credits. Plans may include credits, and you can buy more or turn on automatic top-ups. Monthly credits included with your plan, and promotional bonus credits other than welcome credits, expire 90 days after they are added to your account. Welcome credits, and credits you buy separately, including automatic top-ups, do not expire. When you spend credits, the ones that expire soonest are used first.
• You can cancel from your billing settings. Cancelling stops renewal and your plan stays active until the end of the paid period. If a renewal payment has failed, cancelling ends the plan right away and the unpaid invoice is cancelled.
• Advertising spend is billed to you directly by the advertising platforms, not by ToMarket.

Do not use the service to violate any law or platform policy, infringe others’ rights, impersonate anyone, create misleading or harmful ads, or attempt to disrupt or gain unauthorized access to the service or other users’ data.

The service is provided “as is” without warranties of any kind. AI-generated creative, copy, research, and recommendations may contain errors; you are responsible for reviewing them before publishing. We do not guarantee any advertising outcome or performance.

To the maximum extent permitted by law, ToMarket is not liable for indirect, incidental, or consequential damages, or for advertising spend, lost profits, or platform account actions arising from your use of the service.

You may stop using the service and disconnect your accounts at any time. We may suspend or terminate access for violations of these Terms or for non-payment.

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law rules. Any dispute will be heard in the state or federal courts located in the State of Florida, and you and we consent to their jurisdiction.

We may update these Terms; material changes will be reflected by the “last updated” date above. Continuing to use the service after a change means you accept it.
